Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of TheDeskMonitor services. By creating a TheDeskMonitor account or accessing our platform, you agree to comply with this policy. Violation of this policy may result in immediate suspension or termination of your account.

1. Permitted Uses

TheDeskMonitor is designed for lawful workforce monitoring, time tracking, and productivity analytics. Permitted uses include:

  • Monitoring the productivity and work activity of employees who have been notified of and consented to monitoring in accordance with applicable law
  • Tracking time worked by contractors, freelancers, and employees for payroll and billing purposes
  • Managing shift schedules, leave requests, and project budgets for your organisation
  • Generating payroll, performance, and compliance reports for internal business use
  • Providing read-only project access to clients under the Client Guest Access feature

2. Prohibited Uses

You must not use TheDeskMonitor to:

2.1 Unlawful Monitoring

  • Monitor individuals without their knowledge where local law requires notification or consent
  • Monitor individuals who are not your direct employees, contractors, or agents
  • Monitor personal devices without express written consent from the device owner
  • Circumvent or disable privacy controls (Privacy Mode, Smart Blur) for the purpose of capturing data the platform is designed to protect

2.2 Data Misuse

  • Use monitoring data for purposes beyond workforce management (e.g., selling employee data to third parties)
  • Discriminate against employees based on monitoring data in violation of applicable employment law
  • Use productivity scores or activity data as the sole basis for employment decisions without human review
  • Share access credentials with individuals not authorised to access that tenant's data

2.3 Platform Abuse

  • Attempt to reverse-engineer, decompile, or extract source code from the TheDeskMonitor platform
  • Conduct automated scraping, crawling, or load testing without written permission from TheDeskMonitor
  • Attempt to access another tenant's data or circumvent access controls
  • Use the platform to send unsolicited communications (spam) via any platform channel
  • Upload malicious code, viruses, or content intended to damage or disrupt the platform

2.4 Resale and Redistribution

  • Resell access to the TheDeskMonitor platform without a formal reseller agreement
  • White-label the platform beyond the white-label permissions granted in your Enterprise agreement

3. Employer Obligations Toward Employees

As a TheDeskMonitor customer (employer), you agree to:

  • Notify employees of the monitoring activities and the types of data collected before activating monitoring
  • Provide employees access to their own monitoring data as required by applicable law and as enabled by the platform
  • Not weaponise Privacy Mode data — employees' use of the Privacy Mode pause feature must not be used as a basis for negative employment consequences without substantiated cause
  • Maintain a lawful basis for processing under applicable data protection law (e.g., GDPR Article 6, Privacy Act 1988 (Cth))
  • Comply with the Privacy Act 1988 (Cth), the Workplace Surveillance Act 2005 (NSW), and equivalent state and territory legislation as applicable

4. Enforcement

TheDeskMonitor reserves the right to investigate suspected violations of this AUP. Where a violation is confirmed, we may take any of the following actions:

  • Issue a warning and require corrective action
  • Temporarily suspend the offending account or feature access
  • Permanently terminate the account without refund
  • Report illegal activity to relevant law enforcement authorities

5. Reporting a Violation

If you believe someone is using TheDeskMonitor in violation of this policy or applicable law, please report it to . All reports are reviewed by our compliance team.

6. Policy Updates

This AUP may be updated from time to time. Material changes will be communicated via email to account holders or via an in-platform notification. Continued use of TheDeskMonitor after an updated AUP takes effect constitutes acceptance of the revised policy.
